We get a lot of questions asking what level of DBS Check is needed depending on someone's role.
If someone is working with children and vulnerable adults, for example, the type of Enhanced DBS check will be different depending on their day-to-day duties. If their activities involve regulated activity, then a slightly different check will be required than if it only involves unregulated activity.
This guide will go over what unregulated activity is in a DBS check, so you can understand what level you require.
What is Regulated Activity?
To understand what unregulated activity is, it is useful to first know what regulated activity is, or involves.
Regulated activity refers to specific jobs or duties that are carried out by people in certain roles, that are regulated by a governing body or bodies, when working with vulnerable adults and children. The person carrying out these duties would need an Enhanced DBS Check with Barred List Check to ensure that they were not "barred" (prevented) from working in that capacity, due to a previous issue with the vulnerable group they were working with.
Some Examples of Roles Including Regulated Activity
Regulated activity can be broken down into two separate groups: regulated activity with adults, and regulated activity with children.
Regulated Activity With Children
When working with children, regulated activity includes: Personal care, managing or directly supervising the day-to-day activities of anyone who is involved in regulated activity, which could be providing healthcare by a regulated healthcare professional, foster care, or registered childminding, teaching, training, coaching or mentoring, where the person would be working in a specific location (eg: schools, nurseries or children's hospitals), or where the person will have frequent unsupervised contact with children when they work with them 3 or more days.
Regulated Activity With Vulnerable Adults
With vulnerable adults, it's important to understand how vulnerable adults are defined. A vulnerable adult is defined by the Department of Health as a person who is aged 18 or over, who may need care services, because of a disability (mental or other), age, or illness. A person is considered vulnerable if they are unable to look after themselves, protect themselves from harm or exploitation, or are unable to report abuse.
Regulated activity covers duties and activities that involve any personal or healthcare being given to a vulnerable adult, social work, where assistance is being given with shopping or paying bills on behalf of the vulnerable adult, a regulated healthcare professional, where someone through formal appointment is, helping them conduct their own affairs (lasting or enduring power of attorney, as an advocate under Mental health capacity act, etc).

What is Unregulated Activity?
So then, what is unregulated activity?
By definition, it is anything that isn't classified as regulated activity.
Examples of roles where there is unregulated activity include:
Unregulated Activity with Children
Individuals who carry out work which would have been regulated activity with children before changes were made to the definition in September 2012, individuals applying as part of registration to manage any type of agency or accommodation relating to the welfare of children.
Unregulated Activity with Adults
Individuals who work in a high-security psychiatric hospital, those who carry out activities with adults that are specifically defined as work with adults, those that manage, on a day-to-day basis, anyone who carries out activities with adults that are specifically defined as work with adults.
