What Are DBS Checks?

DBS checks are requests to the UK police services to disclose the information they hold on an applicant. If the applicant has applied for, or is doing a regulated activity, an additional check on the barred lists is performed too. There are three levels of disclosure -
Basic DBS check, Standard DBS check and Enhanced DBS check.

What Is the Difference Between DBS Checks?

Basic DBS checks list unspent convictions and cautions, reprimands and final warnings*.

Standard DBS checks list spent and unspent convictions, cautions, reprimands and final warnings*.

Enhanced DBS checks list spent and unspent convictions, cautions, reprimands, final warnings*, plus information held by local police that’s considered relevant to the role. Additionally, if the role is a regulated activity, a check if the applicant is on the list of people barred from doing the role.

*as defined by the Rehabilitation of Offenders Act 1974.

Why Do We Need DBS Checks?

To protect your organisation and the people your organisation is responsible for, DBS (Disclosure and Barring Service) checks reveal your potential candidate’s criminal history. Any organisation can do Basic DBS checks. Standard and Enhanced checks are only available within regulated activities, such as where the applicants are to work with Children or Vulnerable Adults.

Which Type of DBS Checks Do I Need?

Basic disclosures are available for any applicant. Standard and Enhanced are only available to organisations who are entitled by law to ask an exempted question. Select the wrong type, and you could be applying for it illegally, or you could be illegally hiring someone without doing the appropriate checks! There is no official list of job roles requiring a DBS check, but you can find further guidance on this website.

What Is an Exempted Question?

An exempted question is defined as: requesting an Individual to reveal their full criminal history, including spent convictions and cautions. Unless the role is listed in the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (as amended) and where appropriate Police Act Regulations (as amended), it is unlawful to ask an exempted question.

What’s the Difference Between Spent and Unspent Criminal Convictions?

Spent convictions are convictions and cautions that the Rehabilitation of Offenders Act (ROA) 1974 determines have reached the point where the person is to be considered, for most purposes, as if they had not committed the offence. Unspent convictions are convictions and cautions that have not reached this point and will appear on Basic DBS checks. Spent and unspent convictions will appear on Standard and Enhanced DBS checks.

Many convictions can never become spent, e.g. any sentence of imprisonment for more than two years and six months, and some sexual and terrorism offences.

Offences that will never be filtered from a DBS Certificate.

Filtering rules are applied by the DBS service to remove spent convictions and cautions from DBS Certificates.

Do I Need to Apply for More than One Type of DBS Check?

There is some misleading advice on the internet. Although technically, if you can apply for an Enhanced DBS check, you are also legally allowed to apply for a Standard DBS check, please don't waste your money. You should only request the highest level check available for the job role. If you represent an organisation and have a specific question, or would like further guidance, please don't hesitate to contact us.

What Jobs Require a DBS Check?

A DBS check helps companies in their employment decisions. With it, employers can avoid employing people into unsuitable positions. There is no official list of positions, but there is a DBS check guidance for employers.

Positions where DBS Checks Might Be Needed

Positions where DBS checks might be required by law include:

  • Working with children: Schools, Childminders, Foster Carers, Social Workers, Children’s homes.
  • Working in Elderly care, and with people unable to care for themselves: Personal Carers, Nursing Homes, Residential Homes.
  • Working in Healthcare: Hospitals, Day Centres, Drop-in Clinics, Doctors surgeries.
  • Working in Veterinary practices: Vet, Veterinary Nurses, Receptionist.
  • Financial positions: Solicitors, Barristers, Accountants, etc.

Even if your organisation isn’t required to do DBS checks by law, you can still request a Basic DBS check as a preventive measure.

If you are an organisation that is located in England and Wales, you are in the right place. Aaron's Department provides Basic DBS checks, Standard DBS checks, Enhanced DBS checks, Enhanced DBS checks with Barred List information and Adult First checks to such an organisation.

Basic DBS Checks

Suitable for positions of trust or positions involving financial transactions that do not qualify for a Standard or Enhanced check. With the permission of the applicant, any organisation can request a Basic DBS check listing an applicant's unspent convictions and cautions.

What Are Basic DBS Checks?

Used for any position or purpose, Basic DBS checks will supply the applicants with a Certificate containing details of convictions and conditional cautions from the Police National Computer (PNC) that are considered unspent under the Rehabilitation of Offenders Act (ROA) 1974.

To obtain a BASIC DBS check, organisations can register with Aaron's Department's online DBS service here.

To apply for your own DBS disclosure, individuals should go directly to the UK Government's website.

Once a Basic disclosure has been obtained, it may be used several times.

Standard DBS checks

Aaron's Department is a registered Umbrella Body authorised to process Standard DBS checks. Using our system, you can request a Standard DBS check for positions which qualify.

What Are Standard DBS Checks?

A Standard DBS Certificate will contain a filtered list of spent and unspent: convictions, cautions, reprimands, and final warnings from the PNC. Standard DBS checks are available to organisations for positions included in the Rehabilitation of Offenders Act (ROA) 1974 (Exceptions) Order 1975.

Suitable for some roles in the financial and legal sectors; also for people working in an education or care setting including NHS hospitals who have access to regular contact with Children and/or Vulnerable Adults, but are not in a healthcare role.

To obtain a STANDARD DBS check, organisations can register with Aaron's Department's online DBS service here.

Enhanced DBS Checks

Aaron's Department is a registered Umbrella Body authorised to process Enhanced DBS checks. You can use our service to apply for an Enhanced disclosure certificate only for positions and licenses included in both the Rehabilitation of Offenders Act 1974 (Exceptions Order 1975) and the Police Act 1997 (Criminal Records) regulations. Examples of organisations and positions which are eligible for an Enhanced check are personal carers, nursing carers, children supervisor positions, and applicants for gambling licences.

Enhanced DBS Certificates will contain the same PNC information that the Standard DBS check has, and also include any information that the local police force considers to be relevant for disclosure.

What Are Enhanced DBS Checks?

Used for protecting the most vulnerable in our society and available only to organisations, an Enhanced DBS check is a requirement for positions included in both the Rehabilitation of Offenders Act (ROA) 1974 (Exceptions) Order 1975 and the Police Act 1997 (Criminal Records) regulations. Required for positions involving contact with children and/or vulnerable adults of a specified nature within a Regulated Activity.

Enhanced DBS Checks with Barred List Information

If the position is classified as a Regulated Activity under the Safeguarding Vulnerable Groups Act 2006, an additional check must also be completed: the applicant's name must be checked against the DBS Children's Barred List and/or the DBS Adult's Barred List.

When applying for an Enhanced check with Aaron's Department, if your applicants are to carry out a regulated activity, then you can easily opt for a check with the barred lists.

Examples of roles which are required to do barred lists check by law:

  • Teachers
  • Personal carers
  • Taxi drivers

This DBS Certificate will contain all the information of the Enhanced check, with the addition of information from the children’s and/or adult’s barred lists.

DBS Adult First Checks

If you need staff quickly, it is possible to request a quick check of the applicant against the Adult's Barred List before an Enhanced check is processed. If there is no match, your applicant can begin working under supervision with vulnerable adults without having to wait for a DBS Certificate to arrive.

This check can only be requested if you satisfy the following criteria:

- The position you are offering requires a criminal record check by law while being eligible for access to the DBS Adults' Barred List;

- And, at the same time, your organisation has opted for DBS Adult First check in your DBS application in our registration form.

The DBS Adult First check isn't a full DBS check- it is only a temporary solution until the Enhanced DBS Certificate is issued. Then the hiring decision should be reviewed.


There is no quick check on the Children's Barred List!

The DBS Adult First check is not appropriate for someone working with both children and adults. Such applicants must wait for the DBS Certificate to be returned and can only start working after this, depending on the results.

Your organisation ought to consider the following when applying for a DBS check:

Refusal to Hire Due to Convictions

If your organisation’s position doesn’t fall under the ROA 1974 (Exceptions) Order 1975 (organisations/positions/licences which are eligible to decide whether to hire candidates or not based on spent convictions), refusal to hire someone due to a spent conviction may result with prosecution by law.

How Often Should You Renew DBS Checks?

Except for nursing agencies which are required to renew Certificates yearly by law, DBS Certificates have no official expiry date. A DBS Certificate will not contain information on convictions that happened after the Certificate was printed and is obsolete from the moment it is produced. Some authorities suggest a new check every three years but it is the responsibility of each organisation to consider the appropriate renewal timetable.

DBS Checks for Trans-Gender Applicants

All applicants are required to disclose all previous names and addresses to the DBS service. However, if trans-gender applicants want to avoid having to reveal this sensitive information to their potential employer, they should contact the DBS Sensitive Application Team for guidance before submitting an application form.

You can apply for an applicant's DBS check if they are aged 16 years or more.

Different Checks for Scotland and Northern Ireland!

The checks do differ slightly when your organisation is located in Scotland or Northern Ireland. If this is the case, please check Disclosure Scotland or Access Northern Ireland.

The Criminal Records Bureau (CRB) and the Independent Safeguarding Authority (ISA) merged to become the Disclosure and Barring Service (DBS). CRB checks are now called DBS checks. A DBS check is a criminal record check carried out by employers or organisations on prospective applicants, current staff members, visitors, volunteers, prospective foster carers, adoption applicants etc. to check their eligibility to work with or be in contact with children or vulnerable adults.
