Martyn’s Law: What Businesses Need To Know

Introduction: What Is Martyn’s Law?

Martyn’s Law, which is also known as the Protect Duty, is a proposed law in the UK inspired by the Manchester Arena terrorist attack and named in tribute to Martyn Hett, who was killed alongside 21 others in 2017. Its purpose is to legally require public venues, hospitals, schools, and other organisations to implement effective security measures against terrorist threats. Although the law is still in the pre-scrutiny stage, business leaders should start preparing for its implementation.

The Impact Of Martyn’s Law On Businesses

Martyn’s Law will require business owners and event operators to assess the risk of terrorism and implement appropriate security measures. Businesses must evaluate their vulnerability and adopt practical security measures. Additionally, they will need to ensure that their staff receives suitable training on emergency response and identifying suspicious activity.

Preparing for the Protect Duty

Preparedness is crucial to comply with Martyn’s Law. Businesses should review HR policies and procedures, including recruitment and health and safety policies. Ongoing compliance will require vigilance, and businesses can take the following steps:

Regular Reviews: Review policies and procedures periodically to meet legal requirements and stay updated.

Ongoing Training: Provide regular training sessions to keep staff prepared and knowledgeable.

Background Checks: Include Disclosure and Barring Service (DBS) checks in the recruitment process to reduce risk. DBS checks involve verifying an individual’s criminal record to ensure they are suitable for certain roles that involve working with vulnerable individuals or sensitive information. Implementing DBS checks can help businesses make informed hiring decisions and enhance overall security.

Feedback Mechanism: Establish a way for staff to provide feedback and improve security measures.

External Audits: Seek professional security auditors to identify areas for improvement and provide training opportunities.

Timeline and Government Support

The specific date for Martyn’s Law is yet to be determined. The draft Bill will be introduced to the House after the pre-scrutiny process. The legislative process can vary in duration, but businesses will have sufficient time to prepare for the new rules.

As of the 27th of July 2023, There have been concerns about the draft bill in its current form, with a Home Office spokesperson saying “The Government is committed to improving security at public venues and the pre-legislative scrutiny process will ensure we create a strong Bill that delivers on this aim whilst being proportionate.”

“We will carefully review the recommendations of the report, and we are committed to introducing the Bill as soon as Parliamentary time allows.”
